Terms of Service

1. Identity and Scope
These Terms govern your use of Lyra Story, accessible at lyrastory.ai ("Lyra Story", "we", "us"). The service includes the web application, the public API, the SDK (@lyra-mcp/sync), embedded wallet operations facilitated via Privy, and on-chain interactions with Base and Coinbase Smart Wallet.

2. Account Tiers
Lyra Story has three tiers:
- Anonymous local mode — no account required. Projects live entirely on your computer. Cloud mode requires an account. on your device or with our SDK daemon. No data leaves your machine. We assume no liability for content stored in this mode and have no access to it.
- Clerk free — sign in with Clerk for 500 MB of Cloudflare R2 cloud storage, an auto-provisioned Privy embedded wallet, a Coinbase Smart Wallet creator vault on Base, and the ability to receive USDC donations.
- Cloud Plan ($5/month, billed via Stripe) — expanded cloud quota, public sharing on the Explore feed, and additional paid features as released.
3. Acceptable Use Policy
Lyra Story is a creative workspace and learning community for AI filmmakers. The following describes what cloud-mode and public-mode use of the service is intended for. Local-first / anonymous use is not subject to this policy because we have no visibility into it.
Permitted
- Storyboards, keyframes, concept art, animatics, and coherent video clips for film/animation projects.
- Iterative AI generation linked to a creative project tree.
- Public publishing of finished work, with attribution and provenance preserved.
- Educational content (guides, recipes, templates) shared in the Learn section.
Prohibited
- Personal photo backup or generic cloud storage unrelated to creative work.
- Meme dumps, generic stock recycling, or AI slop without curation.
- Copyright infringement — uploading work you do not have the right to use.
- NSFW content outside an artistic context (case-by-case admin review).
- Hate speech, harassment, threats, doxing, or content targeting protected groups.
- Content depicting minors in sexual or suggestive contexts (zero tolerance, reported to authorities).
- Illegal content under the laws of the jurisdictions we operate in.
- Attempts to bypass storage quotas, scoring/selection enforcement, or content review systems.
Discretionary review
Fan art derivatives, public-figure depictions, and gray-area material may be reviewed by our moderation team. We will err toward keeping creative work up unless it clearly violates the prohibited list.
4. Content Review and Consent
Content uploaded to cloud or public modes may be sampled and reviewed by automated systems including Anthropic's Claude vision API (for AUP classification) and AWS Rekognition (for NSFW and violence labels), and by human moderators. Classifications and the snippets used for moderation are retained for up to 180 days (the strike accumulation window).
Uploaded content is not used to train any AI model. Our use of Anthropic's API is covered by their commercial terms which exclude inputs from training.
5. Strikes and Suspension
Violations of the AUP accrue strikes. Strikes expire after 180 days.
- 1 strike — content removed, notification sent, no account action.
- 2 strikes — upload restrictions for 7 days.
- 3 strikes — partial suspension: existing content remains, no new uploads or public publishing.
- 4+ strikes — full suspension. The on-chain creator vault remains accessible to you (you control the Privy keys); we stop facilitating UI and API access.
Appeals. Any strike can be appealed by emailing appeals@lyrastory.ai. Appeals are reviewed within 7 business days. An overturned strike is cleared from your record.
6. Stale-Project Lifecycle
To keep cloud storage costs predictable, inactive cloud-mode projects are flagged after extended periods of no activity. We will email you before any deletion occurs.
- Free tier: after 180 days of no activity, the project is flagged. After a 30-day notice period, files are moved to cold storage. After a further 60 days, files are deleted.
- Cloud Plan: after 365 days of no activity, same flag → notice → cold storage → deletion sequence with longer windows.
- Local-first mode: never affected. Your files on your disk are yours.
7. Embedded Wallet (Privy)
Your embedded wallet is provisioned and operated by Privy. The signing keys are user-controlled — we do not have custody and cannot unilaterally move funds. Privy's terms of service apply to the wallet itself in addition to ours. Loss of access to your Privy account (forgotten credentials, disabled email, etc.) is governed by Privy's recovery policies; we facilitate but do not custody the keys.
8. Creator Vault (Coinbase Smart Wallet)
Every creator on the free tier or above receives a Coinbase Smart Wallet (an audited ERC-4337 smart account) on Base, used as their creator vault. Donations are plain USDC transfers to the wallet address. You can withdraw at any time by signing a transaction with your Privy embedded wallet.
Donations are non-refundable except in cases of vault freeze pending appeal (see §5). On-chain funds are controlled by you, not by Lyra Story.
9. Cloud Plan Subscription
Cloud Plan is billed monthly at $5 USD via Stripe. The subscription auto-renews. Cancellation takes effect at the end of the current period — you keep access through the period you paid for.
Refunds. First-time subscribers may request a prorated refund within 7 days of the initial charge. After that, subscriptions are non-refundable. Email billing@lyrastory.ai.
Downgrade. On cancellation, your projects remain in cloud storage for the post-cancellation grace period (see the lifecycle schedule in §6) before being subject to the free-tier quota. We will not delete files without notice.
10. Local-First Storage Disclaimer
Files stored in browser-local mode (via the File System Access API) or in SDK-linked mode (via the @lyra-mcp/sync daemon) never leave your device. We have no access to them and no ability to recover them. Backups are your responsibility. Use cloud-mode if you want us to mirror your work.
11. Content Ownership and Your Representations
You retain ownership of the content you create. We claim no ownership of your projects. By uploading to cloud mode or publishing to the public Explore feed, you grant us a limited, non-exclusive license to store, process, back up, transmit, and display that content solely to operate the service (including moderation, public display where you opt in, and cloud backup). This license ends when you delete the content or your account, subject to the storage-lifecycle and backup windows described above.
For any content you upload to cloud mode or publish publicly, you represent and warrant that:
- You own it, or you have all licenses, rights, consents, and permissions necessary to upload, store, and publish it — including any third-party copyrighted material, trademarks, or branding it incorporates.
- It does not infringe any copyright, trademark, trade secret, contract, or other right of any third party.
- You have obtained any consent required to depict any real person's likeness, name, or voice (see §12).
- It does not violate the Acceptable Use Policy (§3) or any applicable law.
These representations do not apply to local-first / anonymous projects, which never leave your device and which we cannot see or access (§10).
12. Likeness and Right of Publicity
A real person's face, name, and voice are protected separately from copyright, under right-of-publicity and related laws that vary by jurisdiction. For content you upload to cloud mode or publish publicly, you agree not to:
- Use a real person's likeness, name, or voice for commercial purposes, or in a way that could imply their endorsement, without their consent.
- Depict public figures or celebrities in false, defamatory, or endorsement-implying contexts.
- Misrepresent a real person as having said or done something they did not ("deepfakes" in a misleading or harmful context).
A person depicted in content on Lyra Story may request its removal by contacting abuse@lyrastory.ai; we will review such requests through our takedown process. Full details are in our Acceptable Use & Content Policy.
13. DMCA / Takedown and Repeat Infringers
We respond to valid DMCA takedown notices. To file a notice, contact our designated agent at dmca@lyrastory.ai with the required information (identification of the work, the infringing material, your contact info, a good-faith statement, and a statement under penalty of perjury). We process counter-notices under the standard DMCA timeline.
Repeat-infringer policy. Substantiated infringement accrues strikes (§5). Accounts that repeatedly upload or publish infringing material after notice will be terminated. On-chain creator-vault funds remain under your control regardless of account status.

14. Indemnification and Disclaimers
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Lyra Story and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising out of: (a) content you upload, publish, or generate; (b) your breach of these Terms or the Acceptable Use Policy; (c) your violation of any third party's copyright, trademark, right of publicity, privacy, or other right; or (d) your violation of any applicable law.

15. Service Availability
We operate Lyra Story on a best-effort basis. The free tier carries no uptime commitment. The Cloud Plan targets 99% monthly uptime (measured on the API and cloud storage surfaces; the dashboard and local-first SDK are not part of the SLA). Outage credits, if any, are at our discretion.
16. Age Requirements
Minimum age to create a Clerk account is 13 in the United States and 16 in the European Economic Area. Users under 18 must have parental or guardian consent to subscribe to paid plans or to make donations. We do not knowingly collect data from users below these thresholds; if we learn of an account held by a younger user, we will delete it.
17. Governing Law and Disputes
[Governing law, venue, and arbitration provisions to be finalized by counsel — see legal-gaps.md. Until then, disputes will be handled in good faith via direct communication and may be escalated to non-binding mediation upon either party's request.]
18. Changes to These Terms
We may update these Terms. Material changes will be announced by email and in-app notification at least 30 days before they take effect. Continued use of Lyra Story after the effective date constitutes acceptance of the new terms. The current version is 2026-06-01-draft.
